Q.Is the trademark availability search necessary? A. Yes, absolutely. It is what
determines if you can use a certain trademark without infringing
upon any other marks, and avoids the costly consequences of an
infringement.
Q.
Is the "comprehensive search" the same as a "direct hit" search? A. Absolutely not. The "direct
hit", also called the "exact match" search, will only catch
identical trademarks, whereas the "comprehensive search" will catch
not only identical trademarks, but also trademarks that are similar
in appearance, sound, commercial impression, and connotation. The
"direct hit" search leaves you at high risk of loss of filing fees
and infringement problems that can only be prevented with a
"comprehensive search".
Q.Why am I
left at high risk of loss of government filing fees, and
infringement problems with a "direct hit" search? A. Probably, an example will
help you understand the point. Let's assume your trademark is
"DADA"; the "direct hit" search will catch exclusively all
trademarks that are exactly "DADA". Now, if no "DADA" trademarks are
found, there could be trademarks like "DADAS" or DAADA" or "DHADA
and the like, that you could catch only with a "comprehensive
search", and such a trademarks could be considered confusingly
similar by the U.S.P.T.O. application examiner. If so, a refusal for
likelihood of confusion of your application, will NOT involve a
refund of the government filing fees already paid, and use of your
trademark could constitute an infringement.
Q.Can I perform the trademark search by
myself? A. It
is not advisable that you perform the search by yourself. It takes a
great deal of experience to understand the relevance of a trademark
in finding likelihood of confusion, and to actually perform the
